Terms and Conditions

These Terms and Conditions (“T&C”) govern all purchases of products and services through the kgsstudios.com website or in-person at our studio. By placing an order or scheduling a service, you agree to be bound by these terms.
1. Orders and Payment
Full payment is required to initiate all orders. The following terms apply:
- Limited Edition Prints: Orders are placed exclusively via kgsstudios.com. Full payment is due at checkout. A T&C agreement checkbox, which links to this page, must be accepted during checkout. All sales are final; no cancellations are permitted post-purchase.
- Portrait Sessions: Unlimited sessions include unlimited time and attempts for portrait creation. This does not include original files or additional services beyond what is specified on the invoice. Full payment is due upon commissioning the portrait. All sales are final; no cancellations are permitted post-consultation.
- Gift Certificates: Holders receive a complimentary portrait or a specified print credit. Certificates are restricted to in-person portrait sessions. Certificates are non-transferable and not redeemable for cash or accessories; however, the original recipient may contact the studio in writing to request a one-time transfer to another named individual formally. A refundable reservation fee is required to book a session (this fee may be waived at our discretion). The fee is refunded post-session if no purchases are made. Cancellations within 14 days of the session will forfeit the fee unless rescheduled via a direct phone call.
- Pricing: All prices are clearly displayed at checkout or at the start of a session, in compliance with Texas law.
2. Artistry Approval
Portrait sessions require your explicit approval at the proofing and final pickup stages to ensure your complete satisfaction. Production cannot begin without your signed approval of the final artistry proof.
3. Return and Refund Policy
Due to the custom nature of our work, all sales are final and no refunds or cancellations are offered for commissioned portraits or limited edition prints. For details on handling artwork damaged during shipping, please see Section 4 below.
4. Shipping & Delivery
At KGS Studios, the final delivery of your heirloom is a critical part of our commitment to excellence. Our fulfillment process is designed to be as meticulous and reliable as our artistry, ensuring your investment is safeguarded from our studio to your home. We utilize a multi-tiered, fully insured shipping system tailored to the unique requirements of each work of art.
Limited Edition Fine Art Prints
- Domestic Shipping (USA & Canada): Shipping for our fine art prints is calculated at checkout based on the artwork’s size, weight, and your location. Each piece is professionally packaged to museum standards to ensure its protection.
- International Shipping: For collectors outside of the US and Canada, we provide a “Custom Quote” shipping option at checkout. After your purchase, we will contact you directly to arrange a bespoke, fully insured shipping solution with one of our trusted international fine art handlers.
- Lead Times: Please refer to the dynamic lead times displayed on each product page for an accurate estimate of when your artwork will be ready for shipment.
Commissioned Portraits & Large-Scale Works
- White Glove Service: To ensure a seamless experience, we offer complimentary white-glove delivery and installation for all commissions 24×30 and larger within the San Antonio area, and for commissions 50 inches and larger throughout Texas.
- Bespoke Fine Art Shipping: For all other commissions, a bespoke shipping, crating, and delivery solution will be quoted on your final invoice. We work exclusively with fine art specialists to guarantee secure, insured, and professional handling of your masterpiece worldwide.
International Duties and Taxes: For all international orders, the recipient is responsible for any applicable duties, taxes, or customs clearance fees. These charges are not included in the purchase price or shipping quote and are determined by the destination country.
Damaged Items: In the unlikely event your artwork arrives damaged, your investment is fully protected. Please contact us at support@kgsstudios.com within 48 hours of delivery with clear photographs of the damaged artwork and packaging. We will manage the entire resolution process, including arranging for the return of the damaged piece at our expense and expediting a replacement. Your complete satisfaction is our absolute priority.
5. Product Descriptions
We provide detailed descriptions of all prints and portrait sessions. Limited Edition Prints are accompanied by a Certificate of Authenticity (COA). All portraits are finished with a preservation coating for archival quality.
6. Satisfaction Guarantee
We guarantee the artistry, printing, mounting, and framing of your piece for 90 days. Any issues identified during proof approval or final inspection will be fixed at no cost. For latent defects discovered later, we will repair or replace the product, provided it has been maintained in accordance with standard archival practices. This guarantee excludes damage from mishandling or requests to change artistry that was previously approved.
DTPA Notice: You may have rights under the Texas Deceptive Trade Practices Act. Please contact us to resolve any issues within 60 days before filing a suit.
7. Copyright and Image Use
KGS Studios retains full copyright to all images created by Kevin G. Saunders. To protect our copyright, photography and video recording by clients during sessions is strictly prohibited. We may showcase your finished portrait in our marketing materials, but we will never use your name unless you provide a voluntary testimonial. You may opt out of image sharing at any time via written notice.

9. Inventory Management
Most products are created after payment is received. All limited edition limits are strictly enforced and tracked in our master database to ensure rarity and exclusivity.
10. Travel and Locations
Our primary studio is in San Antonio. We are available to travel for commissioned sessions; these will incur negotiated travel and location fees as disclosed in writing.
11. Frames and Accessories
We offer a selection of museum-grade frames and premium art lights for purchase. All pricing is disclosed during your session.
12. Governing Law and Disputes
The laws of the State of Texas govern this agreement. Before any court action, all disputes must first be submitted to a 30-day mediation process in San Antonio, Texas. Our liability is limited to the amounts you have paid.
